Kaduna Governorship Poll: Governor Sani and Ashiru Bring their dispute to the Appeal Court In the Kaduna Governorship Election dispute, Governor Uba Sani, who is from the All Progressives Congress (APC), has filed a cross-appeal at the Court of Appeal in Kaduna. This appeal is aimed at overturning the controversial alternative ruling of the Governorship Election Tribunal, which had ordered a supplementary poll in the state.
Despite winning the main ruling at the tribunal on September 28, there was an alternative ruling that favored the candidate of the People’s Democratic Party (PDP), Isah Ashiru.Isah Ashiru, in his appeal to the Court of Appeal, provided 24 grounds to challenge the dismissal of his petition and is seeking an order to invalidate Uba Sani’s victory.Governor Sani’s legal team, led by Chief Bayo Ojo (SAN), listed 14 grounds of errors committed by the tribunal in arriving at its second conclusion. They are seeking various orders from the court of appeal, including setting aside the majority decision of the Kaduna State Governorship Election Petition for a supplementary election, dismissing the alternative reliefs granted to the PDP and Isa Ashiru, and striking out
their petition for being statute-barred or non-compliant with the Electoral Act.The appeal by Uba Sani mainly focuses on the alleged errors made by the tribunal, including its reliance on legally inadmissible documents, discrepancies in the Forms EC40G series, and issues related to the fairness of the proceedings. In summary, Governor Uba Sani is challenging the tribunal’s decision to order a supplementary election and the basis on which it was made, while Isah Ashiru is contesting the dismissal of his petition and seeking to invalidate Uba Sani’s victory.
